Terms of Service

1. Validity

These Terms of Service govern all business relationships between Element'Air Sàrl (hereinafter "Element'Air") and its customers. By placing an order or booking a service, you confirm that you have read, understood, and agreed to these Terms of Service. Browsing our website does not create a binding agreement or contractual obligation.

2. Offer and Prices

All prices are listed in Swiss Francs (CHF) and include VAT. Prices, product descriptions, and illustrations are subject to change without prior notice. Delivery times are estimates and may vary due to unforeseen circumstances.

3. Delivery Times

Gift vouchers are issued and mailed via postal service as soon as possible, typically within 1 to 2 business days of order confirmation. For international shipments, delivery times may be longer depending on the carrier. Delays due to supplier issues or incomplete customer information do not entitle customers to compensation.

4. Shipping

Shipping costs are based on Swiss Post rates and include administrative and handling fees associated with product shipment.

5. Payment

Payment options include:

  • Prepayment: Transfer the amount to our bank account; vouchers are sent upon receipt of payment.
  • Invoice: Vouchers are sent with an invoice, and services are activated upon payment. Invoices are due within [insert number, e.g., 30] days of issuance.
  • Cash: Available for in-person pickups at our shop.

6. Validity of Vouchers

Gift vouchers are valid for one year from the date of issue. Extensions may be granted upon request; please contact us at [insert email or phone number] before the voucher expires.

7. Right of Return and Transferability

Gift vouchers are non-refundable but are transferable to another person of your choice. Lost or stolen vouchers cannot be replaced or refunded.

8. Tandem Flight Conditions

  • Age Requirement: Participants must be at least [insert age, e.g., 16] years old. Minors require written parental consent.
  • Health: Participants must be in good physical condition and disclose any medical conditions that could impact their ability to fly.
  • Equipment: Wear appropriate clothing (e.g., sturdy shoes, warm layers). Weight restrictions may apply; check when booking.

9. Liability and Risks

Paragliding is an adventure sport with inherent risks. By purchasing a voucher or booking a flight, you acknowledge and accept these risks. Element'Air Sàrl, its employees, and pilots are not liable for accidents, injuries, or damages during the activity, except in cases of gross negligence or intentional misconduct. We recommend participants carry adequate insurance for paragliding.

10. Cancellation Policy

  • Customer Cancellations:
     - More than [insert number, e.g., 7] days before the flight: Full refund.

     - Less than [insert number, e.g., 3] days: No refund.
  • Element'Air Cancellations: We may cancel or reschedule flights due to weather, safety, or other unforeseen issues. In such cases, we will offer a reschedule or full refund.

11. Photos and Videos

Photos and/or videos may be taken during flights. By participating, you grant Element'Air Sàrl permission to use these materials for promotional purposes without compensation.

13. Legal Notices

The place of jurisdiction is 1997 Haute-Nendaz, Switzerland. Swiss law applies exclusively.
